Definitions
"We", "Our", and "Us" refer to GTQ Tiny Homes and its authorised dealers.
"You" and "Your" refer to the client, customer, or user of our website and services.
"Products", "Goods", "Units" or "Equipment" refer to any product or service provided by GTQ Tiny Homes.
Amendments
We may update these terms at any time. Substantial changes will be communicated when practical. Acceptance of a quote or invoice constitutes acceptance of these terms.
Limitation of Liability
You are responsible for ensuring our products meet your specific needs. We are not liable for any direct, indirect, or consequential loss, including loss of use or property damage. You agree to indemnify GTQ Tiny Homes from any claims relating to these issues.
Warranty
- Stop using the product and contact us immediately if a fault is discovered.
- Contact Us Here with a detailed fault description and supporting photos/documents.
- Repairs or replacements must be authorised by us; unauthorised actions may void the warranty.
- Our warranty covers parts for 12 months from delivery. We may use qualified technicians or contractors to address faults.
- You may be responsible for return delivery costs.
- Warranty may be void if:
- Products are structurally altered or modified
- Installation was not level or properly supported
- Faults cannot be verified or fall within industry standards
- Damage results from neglect, misuse, or environmental factors (e.g., flooding, fire)
- Notification of the fault is unreasonably delayed
- Pest control is your responsibility; proof may be required.
- Saltwater exposure within 15m may void the finish warranty.
- Warranty exclusions reasonably include (but not necessarily limited) normal wear and tear, disconnection/reconnection of services, or disposal of old parts.
Warranty Activation
- Defect / Warranty Reporting must be actioned within 14 days of delivery by contacting us
- Submit sufficient photos showing the full unit and base from different angles.
- Warranty Includes:
- 1-Year Structural Frame Warranty
- 1-Year Fixtures, Fittings & Finishes Warranty (excluding removal/installation costs)
Installation Responsibilities
You are responsible for:
- Using licensed electricians for power connections and certification
- Using licensed plumbers for water, sewer, and grey water connections
- Engaging licensed builders for site setup and compliance tasks
- Using licensed gas fitters for gas installations
- Ensuring safety and indemnifying GTQ Tiny Homes for third-party actions
- Installing smoke alarms as per local laws where additionally required
- Designing and implementing tie-downs or anchors as per site requirements
General Conditions
- You must check local council laws for occupancy and use
- You accept the suitability of the product for your intended use and location
- You bear responsibility for legal compliance and any council penalties
- You understand and accept minor imperfections in finish due to imported components
- You confirm accuracy of quotes and information provided to us
- GTQ Tiny Homes reserves the right to charge interest (10% p.a.) on overdue payments
Quotes, Invoices, and Payment
- Quotes valid for seven (7) days
- 50% non-refundable deposit on placement of order
- Final payment required one week before shipping
Delivery Terms
- Customers may arrange their own freight with notice
- We use third-party transporters; you indemnify us against related losses
- Delivery includes notification and estimated timing
- You are responsible for unloading unless otherwise arranged
- Clear, accessible sites and proper unloading equipment must be available
- Incorrect delivery details or denied access may incur extra fees
- Damage or defects must be reported within Five (5) days of delivery
- Delivery times are estimates; delays may occur due to uncontrollable factors
Force Majeure We are not responsible for delays or non-performance caused by events beyond our control including but not limited to natural disasters, strikes, pandemics, supply shortages, or government actions.
Indemnity You indemnify GTQ Tiny Homes for any losses or claims arising from use of our products or breaches of these terms.
Intellectual Property All intellectual property remains the property of GTQ Tiny Homes. You must not use, reproduce or claim ownership over any part of our designs, trademarks, or documentation.
Governing Law This agreement is governed by the laws of the State Queensland, Australia and disputes must be resolved in that jurisdiction.
GST Compliance Both parties agree to comply with their GST obligations under Australian law.
Title and Risk Title passes on full payment. Risk passes upon delivery or collection.
Advice Disclaimer Any advice we give is general in nature. You are responsible for your own decisions and must assess the product's suitability independently.
Severability If any provision is deemed unlawful or unenforceable, it will not affect the remaining provisions.
Privacy Your data is handled in line with the Australian Privacy Principles. We do not store credit card data. Data may be used for service improvement and analytics. Refer Our Privacy Policy in respect of our website.
Third Parties We do not sell customer data. Any third-party business mentioned is not endorsed by GTQ Tiny Homes.
Disclosure of Information We may disclose personal information if required by law or to protect GTQ Tiny Homes’ legal interests.
Exclusion of Competitors You must not use our materials or processes for competitive purposes. Breaches may result in legal action and recovery of any resulting losses.
Copyright and Usage Restrictions All materials on our website, emails or documents are protected by copyright. You may not reproduce or distribute them without written permission. Limited personal use is allowed if source is acknowledged.
Entire Agreement These terms form the full agreement between you and GTQ Tiny Homes, unless amended in writing or required by law.
Jurisdiction This agreement and all related dealings are subject to the laws of Queensland, Australia. Disputes must be resolved within this jurisdiction.
